UAE Federal Supreme Court Overturns Foreign Resident's Deportation Order in Drug Case

ABU DHABI: The UAE Federal Supreme Court has overturned a deportation order against a foreign resident convicted in a drug use case, while upholding a 30,000 dirham fine originally imposed by the court of first instance.

The legal proceedings originated in Ajman, where a lower court initially found the defendant guilty of drug use and ordered him to pay a 30,000 dirham fine. However, upon appeal, the appellate court replaced the financial penalty with an order for deportation.

Challenging the appellate ruling, the defendant—who was born in the UAE and resides there with his family—took the case to the Federal Supreme Court through his defense counsel, Abdullah bin Hatom.

Legal Grounds: UAE Federal Supreme Court Exceeding Appellate Authority

The defense argued that because the appeal was filed solely by the defendant, the appellate court lacked the legal authority to worsen his legal standing by replacing a fine with deportation.

The Federal Supreme Court reviewed the case and ruled in favor of the defense, noting that while specific legal provisions allow for deportation as an alternative to imprisonment under certain circumstances, a financial penalty cannot be legally converted into deportation under that same statutory basis.

The Supreme Court concluded that the appellate court had overstepped its legal boundaries and worsened the defendant’s position. Consequently, the court partially accepted the appeal, annulled the deportation order, and reinstated the initial 30,000 dirham fine while dismissing other objections raised by the defense.

Important Context on the Ruling

Legal experts note that the Supreme Court’s decision focuses strictly on the legal limits of appellate jurisdiction and sentencing modifications.

The ruling does not constitute an acquittal, nor does it dismiss the underlying charges of drug use against the resident.

While the verdict highlights important procedural protections regarding sentencing modifications on appeal, legal authorities emphasize that it does not serve as a general exemption from deportation for foreign residents. Deportation decisions continue to depend heavily on the severity of the offense, statutory guidelines, and specific legal circumstances.
